To:
All Residents Associations/ Joint Management Body/ Management Corporation, Representatives, Owners and Residents of Taman Mutiara Puchong, Lake Edge, Taman Sri Puchong, Taman Perindustrian Puchong

Greetings! You are invited to attend our ‘free’ consultation services/ counseling sessions at our centre on various Syariah law issues relating to family laws (estate distribution matters, matrimonial issue etc) and civil laws (housing, transfer of property, Wills & Testaments, Joint Management and maintenance of stratified properties, gated and guarded communities and run-of-the mill civil court cases etc). The objectives are to assist residents who have legal problems but do not know where to seek help and to know their rights. There are people who shy away from legal issues because the perception is such that it cost money to speak to lawyers and perhaps, due to time constrained and financial constraint.
Those having complicated legal issues should bring along all your relevant documents for our perusal and comprehensive explanation to you.
We have also invited our Member of Parliament YB Gobind Singh Deo, ADUN YB Teresa Kok and YDP MPSJ, YBhg. Dato Adman Md. Ikshan to attend our inaugural “Free Legal Aid Clinic’ which is made possible by volunteer lawyers and trained counselors from All Women’s Action Society (AWAM) and National House Buyers Assoc (HBA) who are specialized in Syariah laws, family laws, housing and civil laws.

Sincerely:

Registering RAs not that difficult a task

By OH ING YEEN

IN recent years, many residents associations (RA) have been formed as more people realise the need for a unified body to represent the community and decide on issues pertaining to the neighbourhood.

However, some of these RAs are still only pro tem committees as they have either not realised the importance of getting registered or simply do not know the right procedures. There are even cases of two or more RAs situated just a few streets apart in the same neighbourhood.

With the increasing number of RAs hiring security guards, it is also important for RAs to have their accounts audited so that they can provide proof that the money collected from residents is spent in the right manner.

In 1994, it took USJ RA founder Joseph Xavier four months of paper work and travelling to and from the office of the Registrar of Societies (ROS) to have the RA registered.

Seeds of an idea: Many RAs begin with informal meetings among the residents

“We formed the pro tem committee in 1992 and we were among the pioneer residents in USJ back then.

“I had some experience with RAs as I had been a member while I was staying in PJ. We had the support from the residents and the help of the developer who donated a piece of land for us to have a place to hold our meetings.

“We submitted the required details in Bahasa Malaysia to the ROS, such as the name, logo and constituency of our RA. We even had to explain the meaning of our logo.

“It is also important to submit our annual meeting agenda to the ROS yearly. In 1994, we were finally recognised as a legal association. The membership grew from 10 to more than 400 people now,” he said.

Having been a RA founder and chairman and now a residents comittee (JKP) chairman, what does he think are the differences between the RA, the JKP and the Rukun Tetangga (RT)?

“The RTs receive funds from the government, the JKP is given allocations by the council but RAs have to raise their own funds.

“Now, it is easier for the residents to voice out issues affecting them as they can speak to the JKP zone chairmen, who are also municipal councillors, instead of going to the council,” he said.

“The JKPs will also provide a helping hand if the RA needs to raise funds.

“Those who want to learn how to form an RA can attend the JKP meetings and approach the JKP for help.

“Some RAs don’t understand the concept of the JKP despite the briefings as some don’t bother to turn up.”

He stressed that being part of a residents association required some sacrifices.

“Some even asked what they can get in return for joining the RA. It’s not about what you can get out of it but what you can give to the community,” he said.

All-Petaling Jaya Selangor, Residents Associations Coalition (APAC) chairman Liew Wei Beng said it was not difficult to get registered now, provided that the right steps were followed.

“Being a registered organisation gives the RA a legal platform and it is also recognised by the local council.

“You have to prepare your own constitution but you can write it in English.

“There are a few criteria such as you must be a Malaysian citizen above 21 without a criminal record and you can’t be a bankrupt,” he said.

MPSJ gets MCMC to help in war against illegal advertisements

UPDATES
1. LAPORAN MAKLUMAT SYARIKAT PENGIKLANAN HARAM

By THO XIN YI

THOSE who put up illegal advertisements in areas under the jurisdiction of the Subang Jaya Municipal Council (MPSJ) will find their advertised telephone lines barred.

MPSJ president Datuk Adnan Md Ikshan said at the full board meeting yesterday that the council was working with the Malaysian Communica-tions and Multimedia Commission (MCMC) to curb the problem of illegal banners, buntings and stickers offering an assortment of services.

“The MCMC has agreed to co-operate with us on this. We will collect the telephone numbers and submit them to the MCMC, which will then bar the telephone numbers,” he said.

Adnan said the council enforcement personnel would also spray paint on the stickers to cover the numbers.

“This is to let the culprits know that they cannot do such unlawful things in areas under the MPSJ,” he said.

Adnan said those caught red-handed while putting up such advertisements would be fined RM1,000 for vandalism.

He said the MPSJ welcomed ideas and suggestions on redevelopment in certain areas under its jurisdiction, similar to what was being done in Petaling Jaya and Klang under the stimulus package announced by the Selangor government.

“We have received a proposal from a company on redeveloping Kampung Baru Seri Kembangan.

“But it is up to the residents to decide whether they really want it, particularly those staying in old areas that are disorganised and equipped with only poor road and drainage systems,” Adnan said.

“The residents can form a committee and forward their views to us. This is not an overnight job and a long time is needed to study the plans thoroughly,” he said.

The MPSJ is also setting up a wireless broadband access network in the certain zones in the municipality.

“The contractor appointed by the state government will be conducting site surveys to identify the best spots to install the equipment,” Adnan said.

He said the MPSJ also welcomed developers interested in reviving abandoned projects to contact it to discuss their proposals.

Meanwhile, residents will be able to air their grouses and complaints to Selangor local government, research and studies committee chairman Ronnie Liu during a meet-the-people session on May 10 at the Puchong Indah community hall.

Only 2,900 residents of Lestari Puchong get CFs

AFTER waiting for more than six years, more than 2,900 residents from Lestari Puchong received their Certificate of Fitness (CF) from the Subang Jaya Municipal Council (MPSJ) at a handover ceremony at the Jalan LEP 3/1 playground.

Most of the residents expressed happiness at finally getting the CFs.

Ahmad Man, 37, said that he hoped the council would now look into the facilities in the area.

“There are no facilities such as shops, community halls, or public phones and my children are schooling in Cyberjaya, which is about 20 minutes away,” he said.

However, it was not good news for all residents as the waiting for CFs continues for about 8,575 residents of Lestari Puchong.

Some of the them chose the ceremony as an opportunity to express their grievances.

One of the residents, Andri Nasran, who had been living in Taman Lestari Putra since 2003 said that it was unfair to even have the handover ceremony since some of the residents were still waiting for the CFs.

He added that only after turning up for the ceremony did some of the residents discover that only residents from certain phases obtained CFs.

Meanwhile, MPSJ council president Datuk Adnan Mohd Ikhsan said that starting from April 13, 2007, the Certificates of Completion and Compliance (CCC) would be replacing CFs.

Legal action against errant developers

By LIM CHIA YING

LEGAL action will be taken against developers in Selangor who fail to call for a meeting of the Joint Management Body (JMB) under the Building and Common Property (Management & Maintenance) Act 2007.
Selangor Real Property and Housing Board executive director Datin Paduka Alinah Ahmad said the Selangor Land Office had identified several developers who had failed to call for a JMB meeting within the stipulated 12-month period.
In focus: The developers of apartments will be under scrutiny if they fail to form the JMBs.
According to Alinah, the developers were required to hold the meeting within 12 months of the implementation of the Act if the properties were completed and vacant possesion handed over before it came into effect.
For other properties, the JMB meeting would have to be organised within 12 months of the vacant possession hand-over.
The Act was passed by Parliament in December 2006 and was implemented on April 12, 2007.
Alinah was speaking to representatives of about 50 JMBs at a dialogue organised by Subang Jaya assemblyman Hannah Yeoh, the Zone 1 Residents Committee (JKP) and the Subang Jaya Municipal Council.
National House Buyers Association (HBA) honorary secretary-general Chang Kim Loong, who was one of the speakers at the dialogue, advised all buyers of stratified property to lodge complaints with the Land Office if the developers failed to apply for strata titles within six months of the issuance of the Certificate of Fitness.
Chang said there were still some teething problems and loopholes in the Act. He pointed out that there were no regulations within the Act and that the Commissioner of Buildings (CoB) lacked prosecutorial powers againts defiant developers.
“Problems often crop up during the transition period after the CF is given but before the strata title is issued.
“We have asked the Ministry to issue strata titles together with the CFs or the Certificate of Compliance and Completion (CCC).
“A special focus group is working on this at the moment,” Chang said.
Alinah added that a Management Corporation (MC) would automatically be formed once the strata title book was open.
“However, an AGM of the MC can only be called when 25% of the strata titles have been issued,” she said.
Alinah said she would also ask the Land Office to send letters to inform the CoB once 25% of strata titles for a particular development have been issued.
Chang had earlier pointed out that Seremban already had a similar procedure in place.
During the dialogue, the JMB representatives also brought up various issues they faced within their properties.
Yeoh explained that the dialogue aimed to get all the experts in one forum to discuss and iron out the issues. She added that she hoped this would also help the owners find out about their rights.
Also present were MPSJ Zone 1 councillor Theresa Ratnam Thong who acted as the dialogue moderator and MPSJ CoB director Tee Siew Bee.

MPSJ orders developer to rectify problem at Taman Mutiara Puchong

By THO XIN YI

CHANNELLING the rain water into the lake is not the proper way to resolve the soil erosion problem at bank of the lake near Taman Mutiara Puchong, according to Subang Jaya Municipal Council (MPSJ) engineering department deputy director Adnan Derahman.
“There should be no outlet discharging water into the lake. It is an offence under the law and it will also further induce the soil erosion problem,” he said.
Adnan said this during a meeting of the MPSJ with residents of Taman Mutiara Puchong and nearby housing estates and the developers of the housing projects around the lake.

Worsening condition: A file picture of the lake taken recently.

MPSJ deputy president Mohamad Yusoff Ghazali chaired the meeting held at the MPSJ complex in Subang Jaya on Wednesday.

The soil erosion problem was first highlighted in StarMetro in July last year.

The developer’s company was featured in another news report on Jan 6 this year that the problem was caused by rain water flowing from the landscaped area into the lake.

The company has proposed to collect the water into a sump and then channel the water through pipes directly into the pond.

The residents have confirmed that the company has installed the pipes but they want the council to come out with a permanent solution to the problem.

In response, Adnan instructed the company to cover up the drains at the landscaped area.

“The level of the land should be raised so that the water will flow in an opposite direction, instead of flowing into the lake and worsen the soil erosion problem,” he said.

The residents, however, expressed concern that flooding would occur should the water flow into the residential area.

“Due to clogged drains, flood happens during downpours and the water covers up the roads and back lanes,” resident Michael Yeoh said.

Yeoh is the Taman Mutiara Puchong residents’ association assistant secretary and JKP Zone 9 vice-chairman.

Adnan then told the company to clean up the drainage system, giving it three days to submit its work programme to the MPSJ and a further 14 days to rectify the soil erosion problem. During the meeting, it was also revealed that the third phase of the housing project in Taman Mutiara Puchong has yet to be handed over to the MPSJ.

Adnan said the MPSJ would study and evaluate the clogged drains and soil erosion problems before receiving the project from the developer.

“We will conduct checks on the project based on the residents’ complaints,” he said.

Taman Mutiara Residents Association Reply

Dear Cr Chang & Xin Yi,

Thank you for highlighting and bring up the soil erosion issue to the press and the relevant authorities to act before a catastrophe occurs; otherwise the Developer would be very famous for the wrong reason, and the owners of the affected houses (should the houses collapse into the eroded lake edge) would have their properties "gone with the water" and the whole Taman house value "gone down the drain".From a layman's view, the cause was that there was no sheet piling done at the lake edge. The last soil collapse reached the last corner house whose entire garden and fence disappeared, which prompted the Developer's immediate action to re-fill hundreds of lorry loads of soil to maintain the lake edge to its present distance from the lake, as confirmed by Gerard's statement.

Rain water supposedly flows into drain holes at road curbs drags with them sand and mud, clogging the holes. Heavy downpour has been causing flood in this stretch next to the lake caused by the clogged holes. Flood water over flows to the lake edge and that's how the soil has been eroded so fast. The Residents' Association has proposed to the Developer rep to install pipes connecting rain water at the curb edge directly into the lake, but was turned a deaf ear probably due to cost factor and the common "contractually not obligated" statement. Instead, the Developer has dug a trench within and along the perimeter fencing and channel the collected rain water out to the same eroded spot, which is not a solution. In fact it would accelerate the soil erosion even faster. Mutiara Puchong experienced not less than 6 times serious flooding. One of the causes was most of the sumps in front of each adjoining house was clogged by sand which impeded water flow to the monsoon drain just outside the entrance of the Taman. Rain water has to flow into holes at the road curb through underground drains to the bigger drain at the north near the TNB high tension area. This is an ex-tin-mine land and the amount of sand being flushed into the holes is massive. MPSJ has to maintain a routine schedule to clear the sump to avoid flooding recurrence.

Taman Mutiara Puchong RA look forward to the meeting with MPSJ, the 3 Developers and RA Committees, and we will bring along photos to support our findings and hope to find a solution to the erosion problem before a calamity happens.Thank you again for your unrelented efforts to help house buyers in championing their cause, which if they fight alone would never be successful.

With regards,
Steven Poh
